SHC dismisses May 12 petition

KARACHI: A constitutional petition filed by the Sukkur Bar Association president Shabbir Sher on the May 12 violence and a ban on the MQM was dismissed Wednesday.

The orders came from a five-member full bench of the High Court of Sindh (SHC) comprising Chief Justice Muhammad Afzal Soomro, Justice Munib Ahmed Khan, Justice Qaiser Iqbal, Justice Nadeem Azhar Siddiqui and Justice Rana M Shamim.

The petition was filed when a seven-member full bench of the SHC asked the petitioner to file a petition if he or his association was an aggrieved party in the incidents of May 12 in which more than 45 people were killed.

Sher then moved the petition, praying the court to declare the MQM a terrorist organization and hold the Sindh government responsible for the incidents that took place on May 12.

As the petitioner was called absent Wednesday, the petition was dismissed for “non prosecution”. Sher kept away from the court to follow the decision made by fellow lawyers who are not appearing before judges who took oath under the PCO.

The same bench adjourned the hearing of another application of contempt of court against former Sindh chief minister Dr Arbab Ghulam Rahim till Nov 23. Iftikhar Javed Qazi, who was detained under the MPO since Nov 5 and released on Monday, is stated to be on “general adjournment” (leave for an advocate) and therefore the matter was adjourned.
