LHC orders police to register murder case against ex-DC

RAWALPINDI – A Division Bench of Lahore High Court (LHC) Rawalpindi Wednesday directed the Federal Capital Police to register a murder case against the suspended Deputy Commissioner (DC) Islamabad Chaudhry Muhammad Ali for allegedly ordering police force to shoot at the villagers on July 27, 2002 when CDA tried to take possession of land in Seri Siral, resulting in the death of two persons.

The DB comprising Justice Justice Muzammil Khan and Justice Shabbar Raza Rizvi issued these directives after accepting the intra court appeal of Muhammad Azam, resident of Village Seri Siral in the jurisdiction of Police Station (PS) Golra.

The court ordered the Station House Officer (SHO) to register a criminal case against the suspended DC Islamabad Chaudhry Muhammad Ali the then director enforcement CDA in the case of attempting to take the possession of land in a village by Capital Development Authority (CDA) with the help of local police and for allegedly ordered the police force to shoot at the villagers.

According to details, Muhammad Azam filed a complaint with police stating that Chaudhry Muhammad Ali leading the raiding party of CDA along with police force ordered the law enforcers to shoot at the resisting villagers that resulted in the death of two villagers Muhammad Latif and Haq Nawaz.

He further alleged that police fired at the houses of the peaceful villagers to deter them.

However, police registered a case against the villagers under the charges of murder, attempt to murder, police encounter and terrorism and refused to entertain the complaint of Azam who moved the high court on August 1,2002 for the registration of an FIR of the incident.

He made Inspector General (IG) Police Islamabad, Director Enforcement CDA and SHO police station Golra respondents in his petition.

Later, a single bench of high court on July 14, 2003 disposed off the petition and directed a senior officer of
FIA to look into the whole incident.

Challenging the order of the single bench Muhammad Azam appealed in the double bench on July 26 2003.
The appellant maintained that different high courts in the country had time and again observed that two different FIRs must be lodged in case of counter version of the both parties.

He further added that police had registered the FIR with out taking into consideration the plea of the villagers. Police in the FIR had declared the death of the two villagers as mystery saying it could not be determined whose bullets caused their death.

The DB of LHC accepted the appeal of Azam and ordered SHO Go;ra to register an FIR against the accused.
