Lawyers condemn PECA Ordinance, proposed governor rule

KARACHI: Former presidents of Supreme Court Bar Association and Sindh High Court Bar Association strongly condemned introduction of Pakistan Electronic Crimes (amendment) Act Ordinance as well Pakistan Tehrik-e-Insaf’s activists attack on the Sindh House in Islamabad and the proposed imposition of Governor Rule in Sindh and asked government to refrain from taking any unconstitutional or undemocratic steps.

Addressing a press conference on Saturday, former SBCA president Yaseen Azad and former SHCBA president Khalid Javed said the constitution has provided procedure for no-confidence motion in the parliament. They asked the speaker National Assemb ly to conduct the house impartially in accordance with the law allowing the no confidence motion as provided under the constitution.

They said the government has imposed certain restrictions and censorship in media which were not even done by the military dictatorship. They said independent media is essential for the democracy in the country and demanded government to withdraw the controversial PECA Ordinance as it violates the freedom of press.

They were of the view that introduction of ordinances to restrain the defecting members of ruling party for casting vote in no confidence motion would be no legal weight at the time when no confidence motion has been tabled in the parliament.

They said the defection clause could not be invoked unless member of the parliament vote against the party discipline. They said the members of the parliament be allowed to vote independently without any compulsion in no confidence motion.

They appealed the government to deal all the political issues in accordance with the law and constitution and all institutions shall perform their duties within their parameters defined under the constitution.
