Jang Group to become co-petitioner

KARACHI – A two-member bench of Sindh High Court on May 18 allowed the Jang Group of Publications to become co-petitioners in the petition of Herald Publications against Chairman Implementation Tribunal (IT) of the 7th Wage Board Award for Newspaper Employees.

The petition has been filed by Abdul Hafeez Pirzada and Muneer A Malik, Advocates, in which it has been alleged that the Chairman, IT, has been inimical towards the petitioners and he be restrained from proceedings with applications of newspapers employees. When the bench comprising Justice Shabbir Ahmed and Justice Khilji Arif Hussain took up the petition, respondent Justice (Rtd) Salahuddin Gandapur, Chairman, IT, was present on the court notice.

Petitioner Hameed Haroon was also present during the proceedings.

Faiz Ghagro, Advocate, representing the employees of Herald Publications, submitted that after filing of the petition, the chairman, IT, in exercise of powers conferred upon him by Section 13 of the Act, had transferred all the 10 petitions filed by the employees of Herald Publications against their employers (petitioner) to the Labour court concerned for their disposal according to the law.

He said these cases are fixed for hearing before the labour court on May 25.

The counsel said in the new situation the petition had become infructuous.

The counsel for the petitioner, however, raised objection and contended that the Chairman, IT, had no power to transfer cases.

The bench asked Advocate Ghagro to submit a copy of the order of the Chairman, IT, by which he had transferred the cases.

The counsels for the petitioner were also asked to file their objections which would be taken up at the next hearing of the petition.

Muhammad Ali Mazhar, Advocate, representing the Jang Group, submitted that his client had similar grievance against the Chairman, IT, and they be allowed to become co-petitioners in the matter against him. Hafeez Pirzada and other petitioners raised no objection and the bench allowed his request.

Next hearing of the petition would be fixed by Roster branch of the SHC.
