SHC issues notice to State in Pearl murder case

KARACHI- A division bench of High Court of Sindh (SHC) comprising Chief Justice Saiyed Saeed Ash’had and Justice Musheer Alam on Friday issued notices to the State for June 10 in a constitutional petition filed against alleged illegal detention of four persons in Daniel Pearl kidnapping and murder case.

The bench was hearing a petition filed by Najma Mehmood, wife of detainee Mehmood Fattani, Yasir, Afzal (brothers of Mehmood Fattani) and Ismail, her brother. Khawaja Naveed Ahmed advocate appeared for the petitioner and submitted that the detainees were arrested on the night between May 28 and May 29 and since then were held in illegal custody at Crime Investigation Department (CID) Centre II, Saddar, Karachi.

He said that alleged detainees were businessmen having no affiliation with any militant organisation. The bench after initial hearing issued notice to the respondents including Home Secretary and Superintendent Police (SP) Investigation. An appellate bench of SHC for Accountability Courts for Karachi, put off hearing of an appeal filed by convicted accused/appellant Abdul Sattar Dero. Barrister Azizullah K Shaikh, counsel for appellant was on his feet when the matter was adjourned.

Earlier, Barrister Shaikh submitted that the trial court based the conviction on video produced by the prosecution containing alleged scenes showing the accused/appellant receiving money from a prosecution witness Khuda-e-Rahim at his (accused’s) residence, instead of giving due weight to the statement of the complainant. This basic approach to the case was wrong, submitted the defence counsel assailing the judgment and conviction by the trial court. The accused/appellant was sentenced on charge of accepting bribe amounting to Rs 1.5 million in two installments of Rs 1,000,000 and Rs 500,000.
