Rapist jailed for 10 years

KARACHI: The same court sentenced a man to 10 years imprisonment for subjecting his 14-year-old stepdaughter to sexual assault.

A fine of Rs50,000 was also imposed on the convict, and in case of default the convict would undergo an additional one year imprisonment. The court ruled that if the fine was recovered, the same would be paid to the complainant as compensation.

Hussain Akbar Shah, son of Safar Mohammad Shah, was accused of raping the girl in Gulistan-i-Jauhar in July 2005.

The judge in his verdict observed that the victim in her statement, which was recorded by a judicial magistrate under Section 164 of the criminal procedure code as well as before the trial court, had testified against the accused and fully implicated him in the case and the same was corroborated by the complainant and medical reports.

The plea of false implication of accused could not be sustained, as no girl would stake her future by blaming her step father for rape, because a girl having this history was always looked down upon and lost respect in society, the verdict said.

Citing the contention of accused that there no evidence available on record to substantiate the case against him except the depositions of the victim and the complainant, the court observed that the disputation of accused was repelled since solitary evidence of complainant, which was fully supported by complainant would be sufficient and inspired confidence.

The court observed that the accused in his statement failed to give any plausible reason as why the witnesses had deposed against him, while the victim was subjected to lengthy cross-examination, but the defence failed to dent the prosecution case.

According to the prosecution, the accused arrived at the victim’s house and asked her that her mother was calling her on July 2, 2005. She went with the accused to his house, where he raped her.
