Pemra GM moves IHC against her premature repatriation

ISLAMABAD: Samina Farzeen, appointed as General Manager on deputation in Pemra, challenged her premature repatriation orders in the Islamabad High Court (IHC) on Thursday.

In her petition, she pleaded that by declaring Pemra’s order of May 17, 2011 as illegal, the same be nullified as issued through the misuse of powers. The petitioner said she noticed very strange situation in the Pemra headquarters following her deputation.

Narrating her ordeal, she said the chairman Pemra went on long leave and his job was assigned to an Executive Member, Dr Abdul Jabbar, who began to victimise the employees for reason best known to him. She said several employees approached the courts for protection of their jobs.

Filed before the IHC Thursday by Abdul Hafeez Amjad advocate, the Ministry of Information and Broadcasting and Pemra have been made respondents in the petition.

The petitioner said her services were acquired on deputation through Ministry of Information on September 7, 2009. She took the charge of general manager on September 7, 2009 in Pemra. The petitioner was to attend Mid Career Management Course (MCMC). During the said course, Pemra issued an office order on April 15, 2011 in which her services were repatriated to the Ministry of Information prematurely. On this the petitioner through a letter on May 12 informed Pemra that her course would end on May 21. But despite that once again Pemra, through another office order on May 17, issued orders of her premature repatriation asking her to report to her parent department on May 21, 2011.

The petitioner said that her premature repatriation order was not only illegal but issued in violation of conditions cited during the acquisition of her services on deputation. She said Pemra has authority no authority under law to repatriate her services before the completion of three years deputation.

The petitioner further said that since chairman Pemra was on leave, the executive member, who was looking after the Pemra affairs, had no locus standi to use administrative powers. It was pleaded in the petition to declare the May 17, 2011 orders of Pemra as illegal and without lawful authority. Justice Muhammad Anwar Khan Kasi will take up the petition for hearing today (Friday).
