Pearl case: State files appeal

KARACHI- An appeal has been filed by the state on Tuesday through Advocate – General Sindh for enhancement of sentence awarded to three co-accused in kidnapping and murder case of Daniel Pearl.

The appeal was filed late after noon on Tuesday seeking enhancement of life term awarded to accused Fahad Nasim, Salman Saquib and Shaikh Adil to death sentence.

The state appeal assailed the lesser sentence on ground that on the same set of evidence, prime accused Ahmed Omar Shaikh was sentenced to death while the remaining respondents/accused were sentenced to life terms.

The charge of kidnapping for ransom carried capital punishment if proved under Anti Terrorism laws, the state appeal said.

The Anti- Terrorism Act (ATA, 1997) provides that both the parties can prefer appeal against an order of a trial court (Anti Terrorism Court) within seven days of a judgment.

The judgment in the above case was, announced Monday morning at Hyderabad by Syed Ashraf Ali Shah, judge, ATC Hyderabad and Mirpurkhas. The trial court judge held Ahmed Omar Shaikh as international terrorist and sentenced him to death while life terms were awarded to three co-accused. Seven accused are shown absconders in the final challan.
