Court orders arrest of SHO, policemen

LARKANA, Oct 8: The Larkana circuit bench of the Sindh High Court on Monday ordered arrest of the Dera Murad Sarki SHO, four head constables and three private persons for keeping a man, Shahbaig Jaffri in illegal detention for more than three and half months.

Justice Amir Hani Muslim of the single bench passed the order on a petition filed by one Gulbahar, who accused SHO Abdul Razzak Thebo, four head constables and three private persons of breaking into their house on May 31, looting valuables and picking up his brother Shahbaig Jaffri.

The petitioner stated that he approached the SHO and the Tangwani TPO to know the reason for his brother’s detention as no case was registered against him.

The police officials failed to give any reason and, instead, asked him to not to raise the issue of the detention, threatening him of dire consequences if he approached the court or higher authorities, he said.

Gulbahar said that his cousin lodged an FIR at the Thul police station against the SHO and policemen for the robbery and kidnapping but the investigation officer disposed it off without recording the statements and sent the summery to the magistrate concerned for approval but the refused to entertain it. The detainee, he said, was released and handed over to his brother on September 23 after he had filed the petition in the high court.

Niaz Ali Ansari advocate on Monday pleaded the case when Kashmor DPO Noor Ahmed Paichoho, the TPO, the SHO and the constables appeared in the court but private respondents failed to turn up.

Gulbaig was produced in the court where he recorded his statement, accusing the SHO and police constables of kidnapping and keeping him in illegal detention at an undisclosed place under the watch of the SHO’s brother.

He said that the police tortured him to force him to sign a land document which he refused, saying that he did not own the land.

The SHO denied the charges though the DPO asked him to confess if he had detained the villager. Additional Advocate-General Ghulam Dastagir Shahani requested the court for instituting an inquiry which the justice turned down.

Justice Muslim ordered the DPO to ensure arrest of the SHO and four police constables and registration of an FIR against them in the light of the statement of the detainee.

The detainee told Dawn outside the court that he would lodge FIR at the Thul police station.
