Daniel case hearing today

KARACHI- Sindh High Court on Thursday adjourned till April 19 hearing of petition, praying to transfer kidnapping and murder case of US journalist Daniel Pearl from Judge Anti-Terrorism Court Karachi Arshad Noor Khan to another court.

When the hearing began on Thursday before a Division bench of Sindh High Court comprising the Chief Justice Sayyed Said Ashhad and Justice Ghulam Rabbani, former Advocate General (AG), Sindh Abdul Hafeez Lakho appeared as Amicus Curi and requested for time to study law point whether or not ATC Judge Arshad Noor Khan attained status of witness after hearing statement of Ahmed Omar Saeed Shaikh in Wall Street Journal reporter Daniel Pearl kidnapping and Murder Case.

The attorney of Shaikh Omar, chief suspect in Daniel Pearl’s kidnapping and murder case, has filed a petition in Sindh High Court challenging the jurisdiction of Anti-terrorism Court’s (ATC) judge Arshad Noor Khan to hear the case.

Hafeez Lakho submitted that court notice was received by him late Wednesday night due to which he could not find time to study the case on specific law point.

Abdul Waheed Katpar advocate appearing for Omar Shaikh when his client was produced before Judge Arshad Noor Khan of ATC-III for obtaining judicial remand, he (Omar Shaikh) in response to a question about Daniel Pearl, said before ATC Judge: “As far as I know he is dead.”

He contended that though his client’s statement was not under oath but the Judge became witness of that statement thus according to the law he could not hear the case.
