PHC rejects appeal in minor girl rape case

PESHAWAR: A division bench of the Peshawar High Court (PHC) on Wednesday upheld the verdict of the anti-terrorism court of Swat by dismissing the appeal of a person convicted in an abduction-cum-rape case of a four-year-old girl.

The convict, Ziarat Gul, had raped a minor girl, Siddiqua, daughter of Malook, in the Lal Qala area of Dir Lower district after abducting her on May 7, 2003.

Malook then lodged an FIR with the concerned police station under Section 6 of the Zina Ordinance read with Section 7 of the Anti-Terrorism Act (ATA).

The medico-legal report and forensic analysis of the swab taken from the victim girl proved that she had been partially raped.

After the forensic reports, the anti-terrorism court convicted Ziarat Gul under Section 10(3) of the Zina Ordinance and sentenced him to 10-year imprisonment on January 10, 2004.

The convict filed an appeal before the Peshawar High Court, praying the court to turn down the judgment of the anti-terrorism court of Swat.

The two-judge bench of the Peshawar High Court, comprising Chief Justice Tariq Pervez Khan and Justice Tallat Qayyum Qureshi, turned down his appeal and upheld the decision of the anti-terrorism court.

Meanwhile, an accountability court on Wednesday convicted a land acquisition collector of Wapda to four-year rigorous imprisonment, coupled with Rs 10.2 million for anomalies in acquiring land for a grid station in Peshawar.

Judge Khalid Badshah announced the conviction after the prosecutor of the National Accountability Bureau (NAB) proved charges of corruption against Najmuddin Dar, a resident of Gujranwala in Punjab province.
