Pemra seeks police help for third time after failure

ISLAMABAD: After repeated failures, the Pemra on Thursday wrote to the Punjab Police for the third time, seeking help against an illegally operating and defaulter cable operator.

A letter (reading Registration of FIR against Mr. Zahid Amir Rana, S/o Rana Amir Allah & others, CEO M/s Regal Star Network (Pvt) Ltd, House No.6, Block-C , Main Boulevard, Faisal Town, Lahore) said the subject person was involved in illegal distribution of cable TV operations and unauthorised satellite TV channels.

Under Sub-section (1) of Section 19 of the Pemra Ordinance 2002 as amended by the Pemra (Amendment) Act 2007, Pemra has the exclusive right to issue licenses for the to issue licenses for the establishment and operations of all broadcast media (e.g.: satellite TV channels & FM Radio Stations) and distribution services (e.g; cable TV operations). Under sub-section (2) of section 19 of the Pemra Ordinance 2002, “No person shall engage in any broadcast media or distribution service except after obtaining a Licence issued under this ordinance.”

Sub-section 3) of Section 33 of the Pemra Ordinance 2002 reads, “Where the violation, or abetment of the violation of any provision of this Ordinance is made by a person who does not hold a licence, such violation shall be punishable with imprisonment for a term which may extend to four year, or with fine, or with both, in addition to confiscation of the equipment used in the commission of the act”.

Under Section 34-A of the Pemra Ordinance 2002, “The Offences under sub-section (3) of Section 33 of this Ordinance shall be compoundable and cognizable.”

U/S 36 Offences by companies.- (1) Where any offence under this Ordinance has been committed by a person who at the time the offence was committed was in charge of, and was responsible to the company for the conduct of the business of the company as well as the company itself shall be deemed to be guilty of the offence and shall be liable to be proceeded against and punished accordingly.

Where the person guilty of an offence under this Ordinance, is a company, corporation or firm, every director, partner and employee of the company, corporation or firm shall, unless he proves that offence was committed without his knowledge, or consent, shall be guilty of the offence and shall be liable to be proceeded against and punished accordingly.”

It may be noted that the operator failed to produce a copy of any valid licence today, the 2nd of December 2014. It is therefore requested that an FIR may be lodged against the CEO and all partners of company as well as all staff of M/s Regal Star Network (Pvt) Ltd for illegal distribution of cable TV services.
