Pemra Balochistan chief seeks suo motu SC action

ISLAMABAD: Pemra Regional General Manager Balochistan Gul Muhammad Kakar has moved an application in the Supreme Court of Pakistan requesting Chief Justice Iftikhar Muhammad Chaudhry to take suo moto notice of his wrongful removal from Pemra Balochistan merely for attempting to implement apex court’s orders and for not complying with unlawful orders of his chairman.

Gul Kakar in his application for suo motu notice also raised the issue of discrimination against him for belonging to Balochistan and removing him from Pemra twice while deputationists from other provinces were not only continuing but also were given extensions.

Kakar mentioned that he was being removed for the second time only for not complying with unlawful orders. He mentioned that rights and quota of province of Balochistan are being violated and ignored and he was facing the wrath only because of implementing the Supreme Court orders.

Kakar also raised before the chief justice the issue of more than 385 illegal appointments made by Pemra by flouting all the rules and regulations.

Kakar discussed in detail the prejudice and wrongful attitude towards all employees belonging to Balochistan.

The application of Gul Kakar reads:

“That the undersigned was serving Balochistan University as Director Administration and awarded Star Award for my remarkable services in the year 2007.

That Pemra hired my services for the period of three years vide letter No.4(739)/2008-P.A dated 27th October 2008.

That ever since the assumption of my duties as Regional General Manager Balochistan the undersigned put no stone unturned not only in achieving the revenue target but also establishing writ of the authority in crucial circumstances of the province. Appreciation letter to this effect was issued by the Director General Operations Pemra. Performance comparison of various RGMs posted in Pemra Balochistan during different periods will clearly reveal the truth and endorse my claim.

That much before fresh recruitment in Pemra, I submitted an application for the permanent absorption as per Pemra Service Rules but quite surprisingly I was repatriated to my parent department vide letter No.F.4(739)/2008-HR dated 23rd November 2009 but same was cancelled vide letter No.F.4(739)/2008-HR dated 7th December 2009.

That after successful completion of 2 years and 3 months the undersigned once again submitted an application for permanent absorption as per Pemra Service Rules vide Regional Office Letter No.RGM/QTA/(01)/2011/186 dated February 23, 2011. In response to this my services were repatriated for the second time again without any reason vide letter No.F.4(739)/2008-HR dated March 2, 2011.

That it appears from the perusal of the official record that my services were repatriated due to personal grudges for not complying with unlawful orders. Moreover, I am being punished for raising my voice against the fresh recruitment through which as many as 385 people have been recruited against 119 advertised posts in the limited press that too through a post box. Time and again I have been asking the present management to regularize the services of those employees in Pemra Regional Office Balochistan who have been serving there for the last many years on contingent basis. This attitude is causing rather aggravating the sense of deprivation among the people of province. A press report to this effect is also attached.

In the light of foregoing above facts it is modestly requested that repatriation Order No.F.4(739)2008-P.A dated 2nd March 2011 issued by GM (HR) Pemra headquarters may please be cancelled in light of Estacada Civil Establishment Code SI.NO.28,30 & 49 and special decision taken by the Federal Government wherein 300 officers belonging to Balochistan were decided to be posted in the various federal departments.
