Man acquitted of rape charges

KARACHI, January 25 2006: The Federal Shariat Court (FSC) on Tuesday January 24 set aside conviction of man in rape case and ordered to release him if not involved in other cases.

Amir Bux was sentenced to 14-years in prison with punishment of whipping 15 stripes by additional district and sessions court Tando Mohammad Khan after found him guilty in committing rape with his stepdaughter on October 30, 2004.

According to prosecution, appellant’s wife Imamzadi accused her spouse of committing rape with his stepdaughter. The case was registered against him under section 10 (3) of Enforcement of Hudood Ordinance in Tando Mohammad Khan police station.

The appeal against conviction was heard by FSC’s division bench comprising Justice Dr Fida Mohammad Khan and Justice S A Rabbani.

The court after hearing arguments of state and appellant counsels and examining the evidence of the case, for reason to be recorded later, allowed appeal and set aside the conviction awarded by the trial court.
