IHC not ready to Implement Right to Information Act: Chief lnformation Commissioner

ISLAMABAD: ( Parliament Times ): Courts are supposed to uphold the laws in the country and for that they themselves are expected to implement and obey the laws first to present example to others but here one of the higher courts of the country is not ready to obey and implement a law that is Right to Information Law and the court is Islamabad High Court.

The worthy Chief Information Commissioner (CIC) Shoaib Ahmed Siddiqui has rejected the observation of the registrar of Islamabad High Court that right to information act is not applicable on the high court according to the ruling of the Supreme Court. The registrar IHC was asked to provide the information in appeal No 2550-02-2023 titles Ali Mujtaba Vs IHC filed before Pakistan Information Commission.

The registrar IHC refused to provide the information referring to the ruling of SCP on 27 Sep 2023 in a petition Mukhtar Ahmad Ali Vs The registrar SCP. The ruling was “Right of Access to Information Act, 2017 is inapplicable to the Supreme Court.

The registrar IHC in response to the letter of registrar information commission that ” Pakistan Information Commission constituted under the act 2017 lacks jurisdiction to entertain appeals against IHC, a constitutional body in terms of section 2(ix) of the Right of Access to Information Act, 2017.”

CIC, dismissed the stance of registrar IHC and passed the order in the appeal on 7 Nov 2023

CIC further noted that SCP in the judgement has not excluded IHC from the application of Right to Information Act 2017.

The petitioner Ali Mujtaba has withdrawn his appeal on which the CIC disposed it off.
