Acquittal plea in Mukhtaran case transferred

MULTAN, April 12,2005: A Lahore High Court (LHC) division bench on April 4 transferred a petition for release of 12 accused in the Mukhtaran Mai gang rape case to other division bench following some reservations by a judge of the bench.

Justice Sheikh Javed Sarfraz told the counsel for the petitioners that Justice Fazal Miran had some reservations about the petition and it had been sent to LHC senior Justice Nazir Ahmad Siddiqui to transfer it to other division bench.

Earlier, the petitioners’ counsel, Muhammad Salim Malik, submitted that the Dera Ghazi Khan anti-terrorism court had acquitted eight accused – Ghulam Hussain, Hazoor Bakhsh, Rasul Bakhsh, Muhammad Qasim, Muhammad Aslam, Allah Ditta, Khalil Ahmed and Ghulam Hussain – and the Lahore High Court Multan bench had also rejected the Mukhtaran Mai’s appeal against their acquittal while five other convicts – Muhammad Fayyaz ,Ghulam Fareed, Allah Ditta, Faiz Bakhsh, Fayyaz Ahmed and Ramzan Pujar – were also acquitted by the high court.

In spite of their acquittal, the Punjab home secretary issued their detention orders on the instructions of the prime minister. First, they were kept under house arrest at the residence of Faiz Bakhsh Mastoi and later shifted to District Jail Muzaffargarh.
