LHC orders release of Kulsoom’s husband

LAHORE, May 28: Lahore High Court Chief Justice Khawaja Muhammad Sharif on Thursday ordered release of Kulsoom Baloch’s husband Fazal Abbas, contingent upon payment of bail bonds, after she denied he abducted her.

The judge issued these directions while disposing of a suo motu hearing into the case.

Earlier, the Rawalpindi SSP operations produced Ms Baloch, who categorically denied the allegations levelled in an FIR registered by Mahmoodur Rehman against Abbas.

The chief justice observed: “She is 25 years old that has not been contested by the complainant party. She is M.A. English and is a teacher. She knows what is bad and what is good. She married Abbas on her own free will.” Reliance is placed upon the case Abdul Waheed versus Asma Jahangir (2004), he added. “In this view of the matter…I am fully satisfied that her statement is without coercion and pressure so relying on her statement…the said FIR is quashed,” he wrote in his order.

The chief justice rejected the request of complainant’s counsel to send the girl to Dar-ul-Aman in view of the voluntary nature of the statement given by Ms Baloch.

In another case registered against Abbas eleven months ago, the chief justice allowed him interim bail for two weeks against Rs10,000 and allowed him to apply to the concerned sessions judge for bail before June 10.

A third case registered against Abbas in Jhang district has been found false and cancelled.

On this, the chief justice directed the SSP operations to release Abbas the moment he files bail bonds.

Justice Sharif directed SSP Operations Yasin Farooq to provide Ms Baloch with security wherever she chooses to reside.
