Complainant warned of trial under Qazf

LAHORE, Sept 3: A two-member bench of the Supreme Court on Monday warned a man of a summary trial under Qazf for accusing his former wife of having illicit relations with her father.

The bench comprised Justice Falak Sher and Justice Chaudhry Ijaz Ahmad.

Fateh Abdul Husain of Jhang had alleged that the child his wife had given birth to was not his because he was impotent. “I am not liable to pay for her maintenance allowance under the law,” he said.

The judge ordered the man to pay maintenance allowance to his daughter and his ex-wife, besides seeking an apology for brining her into disrepute.

“The court will proceed on different grounds if she does not forgive him,” the judge emphasised, adding: “Otherwise the court will hold a trial.”

The judge ordered Husain to come up with the maintenance money within two days and make sure he sought an apology from his former wife. The judge required the presence of his ex-wife as well on the next date of hearing to ascertain whether she would like to have Husain tried for hurling accusations at her.
