Bail of rape accused cancelled

PESHAWAR: The Peshawar High Court on Monday cancelled the bail granted to seven persons by a subordinate court in a case of gang-rape of a schoolgirl.

A bench comprising Justice Pir Liaqat Ali Shah accepted an application filed by the complainant in the case, Haroonur Raheed, who is brother of the girl. After the bench cancelled the bail granted by the subordinate court, the accused were arrested from the courtroom.

Sufyan, Ahsanullah, Mohsin, Mahmood, Jawed, Rashid and Amanullah had been arrested in the case registered in the Karak police station on Feb 24.

They had allegedly kidnapped and gang-raped the 15-year-old, Grade 8 student of a local school. The girl had later managed to escape from captivity and narrated the incident to her family.

The FIR of the case was registered under section 365-B (kidnapping woman), 367-A (kidnapping for purpose of subjecting victim to natural lust) and section 376 (rape) of the Pakistan Penal Code. However, the Karak district and sessions judge had granted bail to the accused.

Advocate Neelum Khan appeared for the complainant and F. M. Sabir represented the state in the case.

They contended that the subordinate court had erred in granting bail to the accused as they were directly charged by the victim in the case. They argued that the victim had recorded her statement under section 164 of the Criminal Procedure Code before the court of judicial magistrate wherein she had charged the accused.
